Under the, in 1994 introduced, Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS) by the WTO, IP became internationally recognized and regularized as to obey the laws of property and this way the neoliberal trade rationale. Conclusively, the pharmaceutical industry is free and encouraged to put patents on their (life-saving) medicines and prevent the production of cheap generics in developing countries that generally cannot afford patented medicines from developed countries. Thus, the presented dilemma is one of the right to property on the one hand and the right to health on the other. The following problem statement results: From a philosophical ethics view, is the TRIPS agreement a morally right act?
